An application has been made under paragraph 2 of Schedule 6 to the Planning Act 2008( 1) (“ 2008 Act”) to the Secretary of State in accordance with the Infrastructure Planning (Changes to, and Revocation of, Development Consent Orders) Regulations 2011( 2) (“ 2011 Regulations”) for a non-material change to the Hinkley Point C (Nuclear Generating Station) Order 2013( 3) (“ 2013 Order”).
The Secretary of State, having considered the application and responses to the publicity and consultation carried out in accordance with regulations 6 and 7 of the 2011 Regulations, has decided to make this Order amending the 2013 Order.
Accordingly, the Secretary of State, in exercise of the powers conferred by paragraph 2 of Schedule 6 to the 2008 Act, makes the following Order.
1. This Order may be cited as the Hinkley Point C (Nuclear Generating Station) (Amendment) Order 2021 and shall come into force on 7th January 2022.
2. The Hinkley Point C (Nuclear Generating Station) Order 2013 (“ the 2013 Order”) is amended as follows.
3.—(1) In Part 1 (Authorised development) of Schedule 1 (Authorised project) to the 2013 Order the description of Work No. 1A is amended as follows.
(2) In paragraph (h)—
(a) omit “Entry Relay Building;”;
(b) for “Auxiliary Administration Centre” substitute “Auxiliary Administration Building”;
(c) omit “EDF Site Offices;”;
(d) omit “Vehicle search area building adjacent to the C182;”;
(e) for “Emergency Response Store” substitute “Back-up Emergency Equipment Store”;
(f) after “Back Up Containerised Generators;” omit “and”; and
(g) at the end of the list, below “Valve Room for Demineralisation Station;” insert—
“Emergency Response Centre; and” and
“Emergency Response Energy Centre.”.
(3) In paragraph (m), omit “, helipad”.
4. In Part 1 (Authorised development) of Schedule 1 (Authorised project) to the 2013 Order in the description of Work No. 1C for “Vehicle search area” substitute “Off-site Delivery Checkpoint”.
5.—(1) Part 3 (Approved plans) of Schedule 1 (Authorised project) to the 2013 Order is amended as follows.
(2) For the approved plans listed in paragraph (3) substitute the approved plans listed in Schedule 1 to this Order.
(3) The approved plans referred to in paragraph (2) are each of those listed under the following headings in Part 3 (Approved plans) of Schedule 1 (Authorised project) to the 2013 Order—
(a) “Site Plans”;
(b) “Unit 1: Cooling Water Pumphouse / Forebay / Outfall Pond / Service Access Buildings 5 & 7”;
(c) “Unit 2: Cooling Water Pumphouse / Forebay / Outfall Pond / Service Access Buildings 6 & 8”; and
(d) “Sewage Treatment Plant”.
(4) Under the heading “Ancillary, Office and Storage”, omit the drawings listed under the following headings, and the headings themselves—
(a) “Entry Relay Building”;
(b) “Off-site Vehicle Search Area”; and
(c) “EDF Site Offices”.
(5) For the heading “Auxiliary Administration Centre” substitute “Auxiliary Administration Building”.
(6) After the approved plans listed under the heading “Services Ventilation Building” insert the lists of approved plans under the new headings “Off Site Delivery Checkpoint”, “Emergency Response Centre” and “Emergency Response Energy Centre”as set out in Schedule 2 to this Order.
6.—(1) Schedule 2 (Requirements) to the 2013 Order is amended as follows.
(2) In paragraph 1(1)—
(a) omit the definition of “HPC Helipad”; and
(b) in the definition of “HPC operational car park”, for “(no. 62)” substitute “(no. 67)”.
(3) In paragraph 2, in sub-paragraph (2) of requirement PW3 for “Rev 03” substitute “Rev 04”.
(4) In paragraph 4—
(a) in sub-paragraph (2) of requirement MS19 for “Rev 03” substitute “Rev 04”;
(b) in sub-paragraph (2) of requirement MS21 for “Rev 03” substitute “Rev 04”;
(c) in sub-paragraph (1)(b) of requirement MS25 omit “, including siting of the helipad”;
(d) in the heading of requirement MS34 for “Helipad Use” substitute “Helicopter Flights”;
(e) in sub-paragraph (1) of requirement MS34 for “using the HPC helipad” substitute “to and from the HPC development site”;
(f) in sub-paragraph (2) of requirement MS34 for “HPC helipad” substitute “HPC development site”; and
(g) in requirement MS35 for “HPC helipad” substitute “HPC development site”.
7.—(1) The undertaker must, as soon as practicable after the making of this Order, submit copies of any new, revised or substituted plans to the Secretary of State for certification that they are true copies of the plans referred to in this Order.
(2) A plan so certified by the Secretary of State is admissible in any proceedings as evidence of the contents of the document of which it is a copy.
(3) In paragraph (1), the “ undertaker” has the same meaning as in article 2(1) of the 2013 Order.

This Order amends the Hinkley Point C (Nuclear Generating Station) Order 2013 (“ the 2013 Order”), a development consent order under the Planning Act 2008.
This Order follows an application under paragraph 2 of Schedule 6 to the Act for a non-material change to allow for changes to the site layout and design of buildings and structures within the permanent development site of Hinkley Point C and amendments to the listed plans in Part 3 of Schedule 1 to the 2013 Order.
This Order, in article 7, provides for the certification of new, revised or substituted plans for use as evidence in proceedings.
The changes to the 2013 Order take effect from the date specified in this Order.
2008 c. 29. Paragraph 2 of Schedule 6 was amended by paragraph 4 of Schedule 8 to the Marine and Coastal Access Act 2009 (c. 23), by paragraphs 1 and 72 of Schedule 13 to the Localism Act 2011 (c. 20), and by section 28 of the Infrastructure Act 2015 (c. 7). There are other amendments to the Act that are not relevant to this Order.
