The Houses in Multiple Occupation (Specified Educational Establishments) (England) (Amendment) Regulations 2022

The Secretary of State makes the following Regulations in exercise of the powers conferred by section 250(2) of, and paragraph 4(2) of Schedule 14 to the Housing Act 2004( 1).

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Houses in Multiple Occupation (Specified Educational Establishments) (England) (Amendment) Regulations 2022 and come into force on 22nd March 2022.

(2) These Regulations extend to England and Wales.

Amendment of the Houses in Multiple Occupation (Specified Educational Establishments) (England) Regulations 2019

2.  In regulation 2(b) (Educational Establishments specified for certain purposes of the Housing Act 2004) of the Houses in Multiple Occupation (Specified Educational Establishments) (England) Regulations 2019( 2)—

(a) at the end of sub-paragraph (b)(i), omit “or”

(b) at the end of sub-paragraph (b)(ii), insert “and”,

(c) after sub-paragraph (b)(ii), insert—

(iii) the Accreditation Network UK/Unipol Code of Standards for larger Developments for Student Accommodation Not Managed and Controlled by Educational Establishments dated 28th February 2022 .

3.  In the Schedule to the Houses in Multiple Occupation (Specified Educational Establishments) (England) Regulations 2019( 3), at the appropriate places insert—

“Stranmillis University College”;
“Westminster College”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

This instrument inserts a new code of practice into regulation 2 and two new educational establishments into the Schedule to the Houses in Multiple Occupation (Specified Educational Establishments) (England) Regulations 2019.

Article 2 provides that an educational establishment that is listed in the Schedule to the 2019 Regulations and is a member of the code of practice specified in regulation 2 of this instrument is not a HMO for the purposes of the Housing Act 2004 (excluding Part 1). Article 3 adds further educational establishments to the list in that Schedule.

A copy of the code of practice referred to has been lodged in the libraries of both Houses of Parliament. A copy of this code can be obtained from the National Code Administrator, Unipol Student Homes, 155-157 Woodhouse Lane, Woodhouse, Leeds LS2 3ED, email[email protected]or online atwww.nationalcode.org.uk.

An impact assessment has not been provided for this instrument as no impact on the private or voluntary sector is foreseen.
