The National Health Service (Charges to Overseas Visitors) (Amendment) (No. 2) Regulations 2023

The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 175 and 272(7) of the National Health Service Act 2006( 1).

Citation, commencement, extent and application

1.—(1) These Regulations may be cited as the National Health Service (Charges to Overseas Visitors) (Amendment) (No. 2) Regulations 2023.

(2) These Regulations come into force on 1st June 2023.

(3) These Regulations extend to England and Wales and apply in relation to England only.

Amendment of the National Health Service (Charges to Overseas Visitors) Regulations 2015

2.—(1) The National Health Service (Charges to Overseas Visitors) Regulations 2015( 2) are amended as follows.

(2) In Schedule 2—

(a) after “Bailiwick of Guernsey” insert “Bermuda”;

(b) after “British Virgin Islands” insert “Cayman Islands”;

(c) after “Norway” insert “Pitcairn, Henderson, Ducie and Oeno Islands”;

(d) for “St Helena” substitute “St Helena, Ascension and Tristan da Cunha”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the National Health Service (Charges to Overseas Visitors) Regulations 2015 ( S.I. 2015/238), which provide for the making and recovery of charges for relevant services provided under the National Health Service Act 2006 (c. 41)to overseas visitors (people who are not ordinarily resident in the United Kingdom).

Regulation 2 adds Ascension and Tristan da Cunha, Bermuda, Cayman Islands, and Pitcairn, Henderson, Ducie and Oeno Islands into the list of countries and territories in Schedule 2 to the National Health Service (Charges to Overseas Visitors) Regulations 2015 meaning that no charges may be made or recovered in respect of relevant services provided to an overseas visitor where the provision of those services is covered by a healthcare agreement with those territories.

A full impact assessment has not been produced for these Regulations as no, or no significant, impact on the private, voluntary or public sector is foreseen.
