This Statutory Instrument has been made in consequence of a defect in the National Security Act 2023 (Consequential Amendments of Primary Legislation) Regulations 2023 ( S.I. 2023/1386) and is being issued free of charge to all known recipients of that Statutory Instrument.

The Secretary of State makes these Regulations in exercise of the powers conferred by section 95 of the National Security Act 2023( 1).
In accordance with section 96(5) of that Act, a draft of these Regulations was laid before and approved by resolution of each House of Parliament.
1.—(1) These Regulations may be cited as the National Security Act 2023 (Consequential Amendment of Primary Legislation) Regulations 2025.
(2) They come into force on the day after the day on which they are made.
(3) They extend to England and Wales, Scotland and Northern Ireland.
2.—(1) The Welsh language text of the Public Services Ombudsman (Wales) Act 2019 (Deddf Ombwdsmon Gwasanaethau Cyhoeddus (Cymru) 2019)( 2) is amended as follows.
(2) In section 69(2)(g)(i), after “1989 (p.6)” insert “, neu o dan adrannau 1 i 4 neu 18 o Ddeddf Diogelwch Cenedlaethol 2023 (p.32)”.

These Regulations amend the Welsh language text of section 69 of the Public Services Ombudsman (Wales) Act 2019 (Deddf Ombwdsmon Gwasanaethau Cyhoeddus (Cymru) 2019) (“ the 2019 Act”) in consequence of the enactment of the National Security Act 2023 (c. 32)(“ the 2023 Act”). These Regulations are further to the National Security Act 2023 (Consequential Amendments of Primary Legislation) Regulations 2023 ( S.I. 2023/1386) which made other amendments of primary legislation, including of the English language text of section 69 of the 2019 Act (but not to the Welsh text).
Section 69(2) of the 2019 Act prohibits the disclosure of information provided to the Public Services Ombudsman for Wales, other than for specified purposes. The effect of this consequential amendment is that information may be disclosed by the Ombudsman for the purposes of proceedings under various offences of the 2023 Act.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen. An impact assessment was produced for the 2023 Act, and is available onwww.legislation.gov.uk.
