The National Assembly for Wales makes the following Order in exercise of the power conferred upon it by section 122 of the Care Standards Act 2000[1] Citation, interpretation and application 1. - (1) This Order may be cited as the Care Standards Act 2000 (Commencement No.1) (Wales) Order 2000. (2) In this Order -
(3) This Order applies to Wales. Section 72 (Children's Commissioner for Wales) Schedule 2 Section 54(1),(3)-(7) (Care Councils) in so far as it relates to the Council Section 55 (Interpretation) Section 113 (2)-(4) (Default powers of appropriate Minister) in so far as it relates to the Council Section 114 (Schemes for the transfer of staff) in so far as it relates to an Order in Council, or a recommendation to Her Majesty to make an Order in Council, under section 70 of the Act (Abolition of Central Council for Education and Training in Social Work) containing a scheme for the transfer of staff from the Central Council for Education and Training in Social Work to the Council Schedule 1 in so far as it relates to the Council (This note does not form part of the Order) This Order appoints a day for certain provisions of the Care Standards Act 2000 ("the Act") to come into force. The Order applies to Wales. The Order provides that the following provisions of Part V of the Act shall come into force on 13th November 2000:
(b) Schedule 2, which makes provision about certain operational functions of the office such as its status, appointment and remuneration, general powers, accounting and reporting.
The Order provides that the following provisions of Part IV of the Act shall come into force on 1st April 2001 in so far as they relate to the Care Council for Wales ("the Council"):
(b) section 55 which makes provision about the interpretation of Part IV of the Act; (c) section 113 (2)-(4) which provides that the Assembly has default powers in relation to the Council; (d) section 114 which makes provision about Orders in Council made under section 70 of the Act that transfer staff from the Central Council for Education and Training in Social Work to the Council; (e) Schedule 1 which makes provision about certain operational functions of the Council such as its status, general powers, membership and appointment, procedure, staff, accounting and reporting. (This note does not form part of the Order)
The following provisions of the Act have been brought into force in relation to Wales, as well as England, by S.I. 2000/2544 (C.72). Notes: [1] 2000 c.14. The power is exercisable by the appropriate Minister. The appropriate Minister is defined in section 121(1) as meaning the National Assembly in relation to Wales; in relation to England, Scotland or Northern Ireland it means the Secretary of State.back
