PREVENTION OF CRUELTY

The Protection of Animals (Anaesthetics) Amendment (Wales) Order 2003

  Made 16th July 2003 
  Coming into force 18th July 2003 

The National Assembly for Wales, in exercise of the powers conferred on it by section 1 of the Protection of Animals (Anaesthetics) Act 1954[1] and now vested in it,[2] after consultation with the Royal College of Veterinary Surgeons and with such persons appearing to the National Assembly for Wales to represent appropriate agricultural interests, that appear to the National Assembly to be appropriate makes the following Order:

Title, application and commencement
     1. This Order is called the Protection of Animals (Anaesthetics) Amendment (Wales) Order 2003, it applies in relation to Wales and comes into force on 18th July 2003.

Amendment of the Protection of Animals (Anaesthetics) Act 1954
    
2. In paragraph 6 of Schedule 1 (Excepted Operations) to the Protection of Animals (Anaesthetics) Act 1954 the words "in Wales, 8 days" are substituted for "in Wales, 4 weeks"[3].

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends paragraph 6 of Schedule 1 to The Protection of Animals (Anaesthetics) Act 1954 (1954 c.46) in its application to Wales by reducing the age beyond which castration of pigs may not be performed without anaesthetic from 4 weeks to 7 days in order to implement Commission Directive 2001/93/EC (OJ No. L 316, 1.12.2001 p. 36). Conditions that apply to the keeping of pigs are contained in the Welfare of Farmed Animals (Wales) Regulations 2001, as amended.
