1] a chan ei fod wedi ei ddynodi[2] at ddibenion adran 2(2) o Ddeddf y Cymunedau Ewropeaidd 1972[3] o ran polisi amaethyddol cyffredin y Gymuned Ewropeaidd a mesurau o ran bwyd anifeiliaid a gynhyrchwyd ar gyfer neu a fwydir i anifeiliaid sy'n cynhyrchu bwyd a mesurau yn y maes milfeddygol ar gyfer diogelu iechyd y cyhoedd, drwy arfer y pwerau a roddwyd gan yr adran 2(2) a enwyd (i'r graddau na ellir gwneud y Rheoliadau hyn dan y pwerau yn Neddf Amaethyddiaeth 1970 a nodir uchod), ac ar ôl ymgynghori fel sy'n ofynnol dan adran 84(1) o'r Ddeddf a enwyd neu fel bo'n briodol dan Erthygl 9 o Reoliad (EC) Rhif 178/2002 Senedd Ewrop a'r Cyngor yn gosod egwyddorion a gofynion cyffredinol cyfraith bwyd, yn sefydlu Awdurdod Diogelwch Bwyd Ewrop ac yn gosod gweithdrefnau mewn materion diogelwch bwyd[4], mae Cynulliad Cenedlaethol Cymru yn gwneud y Rheoliadau canlynol:



RHAN 1

RHAGARWEINIOL A CHYFFREDINOL

Enwi, cychwyn a chymhwyso
     1. Enw'r Rheoliadau hyn yw Rheoliadau Bwydydd Anifeiliaid (Cymru) 2006, deuant i rym ar 25 Ionawr 2006 ac maent yn gymwys o ran Cymru.

Dehongli
    
2. —(1) Yn y Rheoliadau hyn—

(p'un ai a yw'n cynnwys unrhyw ychwanegyn neu beidio) ac sydd i'w ddefnyddio ar gyfer bwydo anifeiliaid anwes neu anifeiliaid fferm drwy'r geg, yn uniongyrchol fel y mae, neu ar ôl ei brosesu, wrth baratoi bwyd anifeiliaid cyfansawdd neu fel cariwr rhag-gymysgedd;

    (2) Rhaid dehongli unrhyw gyfeiriad yn y Rheoliadau hyn at reoliad neu Atodlen gyda Rhif fel cyfeiriad at y rheoliad neu'r Atodlen sy'n dwyn y Rhif hwnnw yn y Rheoliadau hyn, oni fydd y cyd-destun yn mynnu fel arall.

    (3) Lle bynnag, mewn cofnod mewn tabl neu gofnod arall mewn Atodlen i'r Rheoliadau hyn, y gwelir cyfeiriad gyda Rhif at droednodyn, mae'r troednodyn sydd â'r Rhif hwnnw i'w drin fel pe bai'n gynwysedig yn y testun y mae'n berthnasol iddo neu fel pe bai'n ymhelaethu ar y testun hwnnw.

    (4) Rhaid dehongli unrhyw gyfeiriad yn y Rheoliadau hyn at adran gyda Rhif fel cyfeiriad at yr adran sy'n dwyn y Rhif hwnnw yn y Ddeddf, oni nodir yn wahanol.

    (5) Rhaid dehongli unrhyw gyfeiriad yn y Rheoliadau hyn at un o offerynnau'r Gymuned fel cyfeiriad at yr offeryn hwnnw fel y mae wedi ei ddiwygio ar y diwrnod y gwneir y Rheoliadau hyn neu cyn hynny.

Diwygio Deddf Amaethyddiaeth 1970 o ran pob bwyd anifeiliaid
     3. —(1) Mae is-adran (1) o adran 66 yn effeithiol yng Nghymru fel pe bai—

    (2) Mae is-adran (2) o adran 66 yn effeithiol yng Nghymru fel pe bai'r canlynol wedi ei roi yn lle paragraff (b) o'r is-adran honno—

    (3) Mae adrannau 73 a 73A yn effeithiol yng Nghymru fel pe bai'r geiriau "any farmed creatures" wedi eu rhoi yn lle'r geiriau "animals of any description prescribed for the purpose of the definition of "feeding stuff" in section 66(1) of this Act".

    (4) Mae adran 85 yn effeithiol yng Nghymru fel pe bai —

Addasu Deddf Amaethyddiaeth 1970 o ran bwydydd anifeiliaid wedi eu mewnforio
     4. O ran bwydydd anifeiliaid sydd wedi ei fewnforio, bydd adran 69(1) yn effeithiol yng Nghymru fel pe bai'r geiriau "and in either case before it is removed from the premises" wedi'u hepgor.

Deunydd rhagnodedig
    
5. —(1) Yn ddarostyngedig i baragraff (2), y deunydd rhagnodedig at ddibenion adrannau 68(1) a 69(1) yw unrhyw ddeunydd y gellir ei ddefnyddio fel bwyd anifeiliaid.

    (2) At ddibenion y Rheoliadau hyn, ni fydd adran 68(2) yn gymwys.

6. I'r graddau y mae darpariaethau'r Rheoliadau hyn yn gweithredu'r Gyfarwyddeb Bwydydd Anifeiliaid Cyfansawdd (sydd yn bennaf yn rheoleiddio labelu a phecynnu bwydydd anifeiliaid cyfansawdd), nid ydynt yn gymwys o dan yr amgylchiadau a nodir yn Erthygl 14(c) (sy'n ymwneud ag anifeiliaid a gedwir ar gyfer dibenion gwyddonol neu arbrofol) o'r Gyfarwyddeb honno.

7. Mae Rheoliadau 2001, ac eithrio rheoliad 17A a pharagraff 19 o Atodiad 4 i'r Rheoliadau hynny, ac at ddiben paragraff 27 o Atodlen 3 i'r Rheoliadau hyn Rhannau I i VIII o'r Tabl i Atodlen 3 i'r Rheoliadau hynny, wedi eu dirymu, yn ogystal â'r offerynnau diwygio a restrir yn Atodlen 9 ac i'r graddau a bennir yn yr Atodlen honno.



RHAN 2

CYFLWYNO BWYDYDD ANIFEILIAID A'U CYFANSODDDIAD

Materion y mae'n ofynnol eu cynnwys, ac y caniateir eu cynnwys, mewn datganiad statudol neu eu datgan fel arall
    
8. Ac eithrio o ran ychwanegion a rhag-gymysgeddau na chynhwysir mohonynt mewn bwydydd anifeiliaid, bydd y manylion, yr wybodaeth a'r cyfarwyddiadau y mae'n ofynnol, neu y caniateir, eu cynnwys mewn datganiad statudol neu eu datgan fel arall, fel y'u pennir yn narpariaethau Atodlen 3, a rhaid iddynt gydymffurfio â'r darpariaethau hynny.

Ffurfiau o ddatganiadau statudol
    
9. —(1) Ac eithrio pan fo'r amgylchiadau'n ymwneud â symiau bach o fwydydd anifeiliaid yn Erthygl 5(2) o'r Gyfarwyddeb Bwydydd Anifeiliaid Cyfansawdd ac yn ddarostyngedig i baragraff (2), mae'n rhaid i'r datganiad statudol—

    (2) Yn achos unrhyw ddeunydd bwyd anifeiliaid a werthir mewn swm sydd heb fod yn fwy na 10 cilogram, ac a gyflenwir yn uniongyrchol i'r defnyddiwr terfynol, gall y datganiad statudol gael ei roi ar ffurf hysbysiad ysgrifenedig.

    (3) Rhaid i'r manylion, y wybodaeth a'r cyfarwyddiadau y mae'n ofynnol eu cynnwys neu y caniateir eu cynnwys yn y datganiad statudol—

    (4) At ddibenion adran 69 (marcio deunydd sydd wedi ei baratoi ar gyfer i'w werthu), rhaid i ddeunydd rhagnodedig a gynhwysir mewn pecyn neu gynhwysydd arall gael ei labelu neu ei farcio yn y dull sydd wedi ei ragnodi o ran deunydd o'r fath ym mharagraff (1) neu, os yw'n gymwys, (2), a rhaid i'r deunydd hwnnw mewn swmp gael ei farcio drwy arddangos dogfen sy'n ymwneud ag ef mor agos at y deunydd ag y bo'n ymarferol.

    (5) Yn achos unrhyw fwyd anifeiliaid cyfansawdd neu ddeunydd bwyd anifeiliaid y bwriedir ei hallforio i Aelod-Wladwriaeth, rhaid i'r datganiad statudol fod mewn un neu ragor o ieithoedd swyddogol y Gymuned, yn ôl penderfyniad yr Aelod-Wladwriaeth honno.

    (6) Yn achos unrhyw fwyd anifeiliaid, ac eithrio bwyd anifeiliaid sy'n cynnwys ychwanegyn yng nghategori (d) neu (e) o Erthygl 6(1) o'r Rheoliad Ychwanegion heblaw'r rhai yn y grwpiau swyddogaeth a restrir ym mharagraff 4(a), (b) neu (c) o Atodiad 1 i'r Rheoliad hwnnw, y bwriedir ei allforio i Wladwriaeth yr Ardal Economaidd Ewropeaidd nad yw'n Aelod-wladwriaeth, rhaid i'r datganiad statudol fod mewn un neu ragor o ieithoedd swyddogol y Wladwriaeth yr allforir iddi.

Cyfyngu ar amrywio
    
10. —(1) Mae adran 74(2) yn effeithiol yng Nghymru fel pe bai'r geiriau "or the Feeding Stuffs (Wales) Regulations 2006," wedi eu mewnosod ar ôl y geiriau "this Part of this Act".

    (2) At ddibenion adran 74, fel y'i haddaswyd gan baragraff (1), bydd y cyfyngiadau ar amrywiad o ran unrhyw gam-ddatgan mewn datganiad statudol, dogfen neu farc, ynghylch natur, sylwedd neu ansawdd bwyd anifeiliaid, pan fo'r cam-ddatgan yn ymwneud—

fel y'u nodwyd o ran y cyfansoddyn hwnnw neu y fitamin hwnnw, yr elfen hybrin honno neu'r bwyd anifeiliaid hwnnw, yn y cofnod cyfatebol yn yr ail Golofn o'r Rhan berthnasol o'r Atodlen honno.

    (3) At ddibenion Rhan IV o'r Ddeddf neu ddibenion y Rheoliadau hyn, rhaid peidio â thrin manylion o ran unrhyw ddeunydd a gynhwysir mewn datganiad statudol, neu mewn unrhyw ddogfen, neu sydd wedi eu marcio ar y deunydd, neu a ddynodir gan farc ar y deunydd, fel pe baent yn anwir oherwydd unrhyw gamddatganiad ynddynt ynghylch natur, sylwedd neu ansawdd y deunydd—

11. At ddibenion adran 70, rhoddir i'r ymadroddion "bwyd anifeiliaid cydategol" ("complementary feeding stuff"), "bwyd anifeiliaid cyflawn", ("complete feeding stuff") "bwyd anifeiliaid cyfansawdd" ("compound feeding stuff") "bwyd anifeiliaid sy'n cymryd lle llaeth" ("milk replacer feed"), "bwyd anifeiliaid mwynol" ("mineral feeding stuff") a "bwyd anifeiliaid triagl" ("molassed feeding stuff") ym mhob achos yr ystyr a roddir i'r ymadrodd o dan sylw gan reoliad 2(1).

Dull pecynnu a selio bwydydd anifeiliaid cyfansawdd
    
12. —(1) Yn ddarostyngedig i baragraffau (2) a (3), ni chaiff unrhyw berson roi mewn cylchrediad fwyd anifeiliaid cyfansawdd, oni bai ei fod mewn bag neu gynhwysydd, a'r bag neu'r cynhwysydd wedi ei selio yn y fath fodd fel bod y sêl, wrth i'r bag neu'r cynhwysydd gael ei agor, yn cael ei difrodi ac na ellir ei hailddefnyddio.

    (2) Gall bwydydd anifeiliaid cyfansawdd gael eu rhoi mewn cylchrediad mewn swmp, mewn bagiau heb eu selio neu mewn cynwysyddion heb eu selio, yn achos —

    (3) Gall bwydydd anifeiliaid cyfansawdd gael eu rhoi mewn cylchrediad mewn swmp, neu mewn cynwysyddion sydd heb eu selio, ond nid mewn bagiau sydd heb eu selio, yn achos—

13. —(1) Yn y rheoliad hwn, mae unrhyw gyfeiriad at Ran gyda Rhif yn golygu Rhan o Atodlen 2.

    (2) Ni chaiff unrhyw berson roi mewn cylchrediad unrhyw ddeunydd bwyd anifeiliaid o ddisgrifiad a bennir yng ngholofn (3) o Ran II, o dan enw heblaw'r enw a bennir yn y cofnod cyfatebol yng ngholofn (2) o'r Rhan honno.

    (3) Ni chaiff unrhyw berson roi mewn cylchrediad unrhyw ddeunydd bwyd anifeiliaid nas rhestrir yn Rhan II o dan enw a bennir yng ngholofn (2) o'r Rhan honno neu dan enw neu derm a allai mewn unrhyw ffordd arall gamarwain prynwr ynglŷn â beth yw'r deunydd mewn gwirionedd.

    (4) Pan fydd enw deunydd bwyd anifeiliaid a restrir yng ngholofn (2) o Ran II yn cynnwys enw neu derm cyffredin a restrir yng ngholofn (4) o Ran I, ni chaiff unrhyw berson roi mewn cylchrediad unrhyw ddeunydd bwyd anifeiliaid o'r fath nac unrhyw fwyd anifeiliaid cyfansawdd yn cynnwys deunydd bwyd anifeiliaid o'r fath oni bai fod y deunydd bwyd anifeiliaid wedi cael ei baratoi drwy'r broses a bennir yng ngholofnau (2) a (3) o Ran I sy'n cyfateb i'r enw neu derm cyffredin hwnnw.

    (5) Ni chaiff unrhyw berson roi mewn cylchrediad unrhyw ddeunydd bwyd anifeiliaid nac unrhyw fwyd anifeiliaid cyfansawdd sy'n cynnwys unrhyw ddeunydd bwyd anifeiliaid, oni bai—

bod y deunydd bwyd anifeiliaid hefyd yn cydymffurfio â'r darpariaethau ynghylch purdeb botanegol a chemegol a nodir ym mharagraff 1 o Adran II o Ran A o'r Atodiad i'r Gyfarwyddeb Bwyd Anifeiliaid.

    (6) Ni chaiff unrhyw berson ddefnyddio unrhyw ddeunydd bwyd anifeiliaid i lynu deunydd bwyd anifeiliaid arall, os yw swm y deunydd bwyd anifeiliaid a ddefnyddir felly yn fwy na 3% o gyfanswm pwysau'r deunydd bwyd anifeiliaid a lynir.

    (7) Heb ragfarnu adrannau 73 a 73A, ni chaiff unrhyw berson fewnforio i Gymru o wladwriaeth nad yw'n Wladwriaeth yr Ardal Economaidd Ewropeaidd, gyflenwi (heblaw drwy werthu), meddiannu gyda golwg ar ei gyflenwi, na defnyddio unrhyw ddeunydd bwyd anifeiliaid sy'n andwyol neu'n beryglus i anifeiliaid fferm, i anifeiliaid anwes neu, drwy yfed neu fwyta cynhyrchion unrhyw anifail a fwydwyd ar y deunydd bwyd anifeiliaid, i fodau dynol.

    (8) Ni chaiff unrhyw berson roi mewn cylchrediad na defnyddio unrhyw ddeunydd bwyd anifeiliaid sy'n andwyol i'r amgylchedd.

    (9) Ni chaiff unrhyw berson roi mewn cylchrediad na defnyddio unrhyw ddeunydd bwyd anifeiliaid mewn ffordd sy'n debygol o gamarwain ynghylch ei briodweddau.

    (10) Ym mharagraff 5(a) cymerir nad yw "disgrifiad" ("description") yn cynnwys unrhyw ofyniad ynghylch purdeb botanegol, ac at ddibenion y rheoliad hwn ac Atodlen 2 rhaid diffinio "purdeb botanegol" ("botanical purity") yn unol â pharagraff 2 o Adran II o Ran A o'r Atodiad i'r Gyfarwyddeb Deunyddiau Bwydydd Anifeiliaid.

Rheoli cynhyrchion a fwriedir fel bwyd anifeiliaid sy'n cynnwys sylweddau annymunol
    
14. —(1) Yn y rheoliad hwn, mae unrhyw gyfeiriad at golofn gyda Rhif yn golygu colofn o Atodlen 5.

    (2) Ni chaiff unrhyw berson—

os yw'n cynnwys unrhyw sylwedd a bennir yng ngholofn 1 uwchlaw'r lefel a bennir mewn perthynas ag ef yng ngholofn 3.

    (3) Ni chaiff unrhyw berson roi mewn cylchrediad, na defnyddio fel bwyd anifeiliaid, unrhyw fwyd anifeiliaid cydategol—

    (4) Ni chaiff unrhyw berson gymysgu unrhyw gynnyrch a fwriedir fel bwyd anifeiliaid a bennir yng ngholofn 2 sy'n cynnwys unrhyw sylwedd annymunol a bennir yng ngholofn 1 uwchlaw'r lefel a bennir mewn perthynas ag ef yng ngholofn 3 at ddiben gwanedu gydag unrhyw gynnyrch a fwriedir fel bwyd anifeiliaid.

    (5) Ni chaiff unrhyw berson roi mewn cylchrediad unrhyw gynnyrch a fwriedir fel bwyd anifeiliaid, na defnyddio unrhyw gynnyrch o'r fath fel bwyd anifeiliaid, oni bai ei fod—

    (6) At ddibenion paragraff (5), nid yw cynnyrch a fwriedir fel bwyd anifeiliaid a bennir yng ngholofn 2 mewn cyflwr da, yn ddilys ac o ansawdd gwerthadwy os yw'n cynnwys unrhyw sylwedd annymunol a bennir yng Ngholofn 1 ar lefel uwch na'r lefel a bennir ar gyfer y sylwedd hwnnw yng ngholofn.

    (7) At ddibenion paragraff (3) mae "bwyd anifeiliaid" ("feeding stuff") yn cynnwys bwyd anifeiliaid i'w fwydo drwy'r geg i anifeiliaid sy'n byw yn rhydd yn y gwyllt, a dehonglir "bwyd anifeiliaid cydategol" ("complementary feeding stuff") a "bwyd anifeiliaid cyflawn" ("complete feeding stuff") yn unol â hynny.

    (8) Mae paragraff (9) yn gymwys ar gyfer unrhyw berson sydd ag unrhyw un o'r cynhyrchion canlynol a fwriedir fel bwyd anifeiliaid yn ei feddiant neu o dan ei reolaeth at ddibenion masnach neu fusnes—

15. —(1) Ni chaiff unrhyw berson roi mewn cylchrediad i'w ddefnyddio fel bwyd anifeiliaid, na defnyddio fel bwyd anifeiliaid, unrhyw ddeunydd sy'n cynnwys—

    (2) At ddibenion paragraff (1) mae i "gwastraff" yr ystyr a roddir i "waste" yn Erthygl 1 o Gyfarwyddeb y Cyngor 75/442/EEC[25].

     16. —(1) Yn ddarostyngedig i baragraffau (3) a (4), ni chaiff unrhyw berson werthu, na meddiannu gyda golwg ar werthu, i'w ddefnyddio fel bwyd anifeiliaid neu fel ffynhonnell protein mewn bwyd anifeiliaid, unrhyw ddeunydd sy'n perthyn i grŵp cynhyrchion a bennir yng ngholofn 1 o Atodlen 6, oni bai bod y deunydd hwnnw—

    (2) Yn ddarostyngedig i baragraff (3), ni chaiff unrhyw berson werthu, na meddiannu gyda golwg ar werthu, i'w ddefnyddio fel bwyd anifeiliaid, na defnyddio fel bwyd anifeiliaid, unrhyw gynnyrch a geir o furumau o'r math "Candida" a dyfir ar n-alcanau.

    (3) Ni fydd paragraffau (1) a (2) yn gymwys o ran unrhyw ddeunydd neu gynnyrch sydd wedi ei hepgor o gymhwysiad y Gyfarwyddeb Cynhyrchion Penodol gan Erthygl 16 ohoni yn ymwneud ag allforion i drydydd gwledydd.

    (4) Ni fydd paragraff (1) yn gymwys o dan yr amgylchiadau a awdurdodwyd ar gyfer rhanddirymiad gan Erthygl 3.2 (yn ymwneud â dibenion gwyddonol neu arbrofol) o'r Gyfarwyddeb Cynhyrchion Penodol.

18. —(1) Ni chaiff unrhyw berson roi mewn cylchrediad—

The energy value of compound poultry, ruminant and pig feeds and feeding stuffs intended for particular nutritional purposes for cats and dogs is calculable in accordance with the relevant formulae set out below, on the basis of the percentages of certain analytical components of the feed. After application of these formulae, the results must be given to one decimal place.

Poultry feeds: megajoules (MJ) of metabolisable energy (ME), nitrogen corrected, per kilogram of compound feed.

MJ of ME/kg of feed = 0.1551 × % protein(¹) + 0.3431 × % oil(²) + 0.1669 × % starch(³) + 0.1301 × % total sugar (expressed as sucrose)(4).

Ruminant feeds: megajoules (MJ) of metabolisable energy (ME) per kilogram of dry matter in the compound feed.

MJ of ME/kg of dry matter = 0.14 × % Neutral detergent Cellulase plus Gamanase Digestibility(5) + 0.25 × % oil(²).

Pig feeds: megajoules (MJ) of digestible energy (DE) per kilogram of dry matter in the compound feed.

MJ of DE/kg of dry matter = 17.47 + 0.079 × % protein(¹) + 0.158 × % oil(²)− 0.331 × % ash(6)− 0.140 Neutral Detergent plus Amylase Fibre(5).

NB Where the results of analysis are to be given on a dry matter basis, this may be achieved by analysing either the dried material, or fresh material and correcting for the moisture content.

Where any person puts into circulation any feeding stuff to which there has been added in the course of manufacture or preparation for putting into circulation, an additive of any of the kinds specified below (other than as an authorised intermediate product or an authorised medicated pre-mix or an authorised intermediate product within the meaning of Council Directive 90/167/EEC[
36]) and which is not excluded from application of the Additives Directive by Article 22 of that Directive (concerning exports to third countries), the following particulars must be contained in the statutory statement—

     15. —(1) The particulars specified in paragraph 11(a)(ii), (b)(ii), and (c)(ii) to (vii) are not required in the case of any feed material which is a by-product of vegetable or animal origin derived from agro-industrial processing, and which has a moisture content greater than 50% .

    (2) For the purposes of this paragraph, "agro-industrial processing" has the same meaning as in the Feed Materials Directive.

     16. —(1) Subject to sub-paragraph (2), in the case of any feed material which is put into circulation by any person, information may be provided in addition to the particulars required or permitted to be contained in the statutory statement or otherwise declared.

    (2) Any such information provided in addition to the particulars required or permitted to be contained in the statutory statement or otherwise declared must—

Compound feeding stuffs: general
     17. —(1) Subject to sub-paragraph (2), in the case of any compound feeding stuff, the following particulars must be contained in the statutory statement—

     19. —(1) In the case of any compound feeding stuff other than a whole grain mix, the statutory statement—

for consistency with Article 5 of the Compound Feeding stuffs Directive.

    (2) In the case of a whole grain mix which is put into circulation, the statutory statement may include such of the declarations provided for in the columns of Part II of this Schedule as may be included for consistency with Article 5 of the Compound Feeding stuffs Directive.

     20. —(1) In the case of any compound feeding stuff other than a whole grain mix, the moisture content must be declared in the statutory statement if it exceeds the following levels—

    (2) In the case of a whole grain mix, or a compound feeding stuff with a moisture content not exceeding the limits stated in sub-paragraph (1) which is put into circulation, the moisture content may be declared in the statutory statement.

     21. In the case of any compound feeding stuff having a level of ash insoluble in hydrochloric acid not exceeding the relevant level specified in regulation 18(1)(a) or, as the case may be, (b), that level may be declared in the statutory statement as a percentage of the feeding stuff as such.

     22. In the case of any compound feeding stuff, the following particulars may be included in the statutory statement—

     23. —(1) In the particulars required or permitted by paragraphs 18 to 21 and 25 and by paragraph 19 of Schedule 4 to the 2001 Regulations to be set out in the statutory statement—

    (2) An expression of an amount as being within a range of percentages set out in the statutory statement will not be regarded as compliance with sub-paragraph (1).

     24. —(1) Subject to sub-paragraph (2), in the case of any compound feeding stuff, information may be provided in addition to the particulars required or permitted to be contained in the statutory statement or otherwise declared.

    (2) Any information provided pursuant to sub-paragraph (1) must—

Compound pet food: specific provisions
     25. —(1) In the case of any compound feeding stuff for dogs or cats, all the feed materials must be declared in the statutory statement.

    (2) In the case of any compound feeding stuff for pet animals other than dogs and cats, the feed materials may be declared in the statutory statement, provided where so declared all the feed materials must be included in the declaration.

    (3) Subject to paragraph 29(2) below and paragraph 3 of Chapter B of Schedule 7, feed materials declared in accordance with sub-paragraph (1) or (2) above must be declared either—

and the use of one of those forms of declaration precludes the use of either of the others, except—

     26. Where any declaration under paragraph 25 above or under paragraph 19 of Schedule 4 to the 2001 Regulations is by specific names, any feed material described in column 3 of Part II of Schedule 2 must be declared by the corresponding name specified in column 2 of that Part (the inclusion of any word appearing in brackets in that column being optional).

Complementary feeding stuffs
     27. —(1) In the case of any complementary feeding stuff which, subject to Article 10 of the Additives Regulation, is put into circulation and contains any additive in excess of the maximum content in relation to complete feeding stuffs specified for that additive in the relevant Part of Parts I to VIII of the Table to Schedule 3 to the 2001 Regulations or, as the case may be, in the relevant European Community Regulation, and which is not covered by Article 22 (concerning exports to third countries) of the Additives Directive, the instructions for use in the statutory statement must state, according to the species and age of the animal, the maximum quantity in grams or kilograms of the feeding stuff which, under these Regulations, may be given per animal per day, and must be so formulated that, when they are correctly followed, the final content of the additive in relation to complete feeding stuffs does not exceed the maximum so specified in relation to them.

    (2) Sub-paragraph (1) does apply to any products delivered to manufacturers of compound feeding stuffs or to their suppliers.

Ingredients to which particular attention is drawn
     28. —(1) Subject to sub-paragraph (2), in the case of any compound pet food, or of any feeding stuff intended for a particular nutritional purpose for animals other than pet animals which is put into circulation, particular attention may be drawn in the statutory statement, or elsewhere on the package, label or container, to the presence or low content of one or more ingredients which are essential aspects of the characteristics of the feeding stuff.

    (2) Where particular attention is drawn to the presence or low content of any ingredient, as permitted by sub-paragraph (1), the minimum or maximum content, expressed in terms of the percentage by weight of that ingredient, must be clearly indicated—

Feeding stuffs for particular nutritional purposes
     29. —(1) Subject to sub-paragraph (2), in the case of any feeding stuff intended for a particular nutritional purpose which is put into circulation, the following particulars must be contained in the statutory statement—

    (2) The particulars required by sub-paragraph (1) to be contained in the statutory statement must be declared in accordance with the requirements of paragraphs 3-7 and 9 of Chapter B of Schedule 7.

     30. —(1) Subject to sub-paragraph (2), in the case of any feeding stuff intended for a particular nutritional purpose which is put into circulation, particular attention may be drawn in the statutory statement, or elsewhere on the package, label or container, to the presence or low content of one or more analytical constituents which are essential aspects of the characteristics of the feeding stuff.

    (2) Where particular attention is drawn to the presence or low content of any analytical constituent, as permitted by sub-paragraph (1), the maximum or minimum content, expressed in terms of the percentage by weight of that analytical constituent, must be clearly indicated in the list of analytical constituents.

Permitted protein products
     31. —(1) In the case of any product named as a permitted product in column 2 of Schedule 6, the statutory statement must contain, in addition to any other particulars required by these Regulations, the name specified for that product in column 7 of that Schedule, together with such further particulars as may be specified in that column in relation to it.

    (2) In the case of any compound feeding stuff containing, for use as a protein source, any product named as a permitted product in column 2 of Schedule 6, the statutory statement must contain, in addition to any other particulars required by these Regulations, the name specified for that product in column 7 of that Schedule, together with such further particulars as may be specified in that column in relation to compound feeding stuffs containing that product.

PENNOD B

     1. Where there is more than one group of nutritional characteristics indicated in column 2 of Chapter A, denoted by "and/or", for the same nutritional purpose, the feeding stuff may have either or both groups in order to fulfil the nutritional purpose specified in column 1.

     2. Where a group of additives is mentioned in column 2 or column 4 of Chapter A, the additive(s) used must be authorised as corresponding to the specified essential characteristic.

     3. Where the source(s) of feed materials or of analytical constituents is/are required in column 4 of Chapter A the manufacturer must make a specific declaration (i.e. specific name of the feed material(s), animal species or part of the animal) allowing the evaluation of conformity of the feeding stuff with the corresponding essential nutritional characteristics.

     4. Where the declaration of a substance, also authorised as an additive, is required by column 4 of Chapter A and is accompanied by the expression "total", the declared content must refer to, as appropriate, the quantity naturally present where none is added or the total quantity of the substance naturally present and the amount added as an additive.

     5. The declarations specified in column 4 of Chapter A which include the words "if added" are required where the feed material or the additive has been incorporated or its content increased specifically to enable the achievement of the particular nutritional purpose.

     6. The declarations to be given in accordance with column 4 of Chapter A concerning analytical constituents and additives must be expressed in quantitative terms.

     7. The recommended period of use indicated in column 5 of Chapter A indicates a range within which the nutritional purpose should normally be achieved. Manufacturers may refer to more precise periods of use, within the permitted range.

     8. Where a feeding stuff is intended to meet more than one particular nutritional purpose, it must comply with the corresponding entries in Chapter A.

     9. In the case of a complementary feeding stuff intended for a particular nutritional purpose, guidance on the balance of the daily ration must be provided in the instructions for use.
