Mae Gweinidogion Cymru yn gwneud y Rheoliadau hyn drwy arfer y pwerau a roddwyd iddynt gan adrannau 4, 5 a 40(1) o Ddeddf Cynllunio (Sylweddau Peryglus) 1990(1).

Enwi, cychwyn, cymhwyso a dehongli

1.–(1) Enw'r Rheoliadau hyn yw Rheoliadau Cynllunio (Sylweddau Peryglus) (Diwygio) (Cymru) 2010 a deuant i rym ar 19 Mawrth 2010.

(2) Mae'r Rheoliadau hyn yn gymwys o ran Cymru.

2. Yn y Rheoliadau hyn–

Diwygio Rheoliadau Cynllunio (Sylweddau Peryglus) 1992

3.–(1) Diwygir y Rheoliadau Sylweddau Peryglus fel a ganlyn.

(2) Yn rheoliad 2(1)(dehongli) yn y diffiniad o "the Directive", ar ôl "substances" mewnosoder "(as amended by Directive 2003/105/EC of the European Parliament and of the Council(3))".

(3) Yn rheoliad 4(6)(esemptiadau) yn lle "6, 14, 35 and 39" rhodder "10, 18, 39 and 43."

(4) Yn lle Atodlen 1 (sylweddau peryglus a maintioli sydd dan reolaeth) rhodder yr Atodlen 1 a osodir yn yr Atodlen i'r Rheoliadau hyn.

Darpariaeth drosiannol: cydsyniadau presennol

4.–(1) Mae'r rheoliad hwn yn gymwys i sylwedd, i beth a gymysgir neu i beth a baratoir o fewn ystyr rheoliad 3 o'r Rheoliadau Sylweddau Peryglus, ac a ddisgrifir mewn cydsyniad sylweddau peryglus a roddwyd (neu y bernir iddo gael ei roi) cyn bod y Rheoliadau hyn wedi dod i rym–

(a) os bydd disgrifiad y sylwedd hwnnw, y peth a gymysgir neu'r peth a baratoir yng ngholofn 1 o Ran A neu Ran B o Atodlen 1 i'r Rheoliadau Sylweddau Peryglus fel y mae cyn i'r Rheoliadau hyn ddod i rym yn cael ei ddiwygio o ganlyniad i ddyfodiad y Rheoliadau hyn i rym; a

(b) os yw'r cydsyniad sylweddau peryglus yn bodoli mewn perthynas â'r sylwedd hwnnw, y peth a gymysgir neu'r peth a baratoir sydd dan sylw yn union cyn dyfodiad y Rheoliadau hyn i rym.

(2) Mewn perthynas â sylwedd, peth a gymysgir neu beth a baratoir y mae'r rheoliad hwn yn gymwys iddo, caniateir anwybyddu'r diwygiadau a wneir gan y Rheoliadau hyn wrth ddehongli'r cydsyniad sylweddau peryglus i'r graddau y mae'n ymwneud â'r sylwedd hwnnw, y peth a gymysgir neu'r peth a baratoir neu'r maintioli ohono sydd dan reolaeth.

(3) Mae paragraff (2) yn peidio â bod yn gymwys os yw'r cydsyniad sylweddau peryglus mewn perthynas â'r sylwedd hwnnw, y peth a gymysgir neu'r peth a baratoir neu'r maintioli ohono sydd dan reolaeth yn cael ei addasu gan yr awdurdod sylweddau peryglus ar 19 Mawrth 2010 neu wedi hynny.

Esemptiadau Trosiannol

5.–(1) Ni chyflawnir tramgwydd o dan adran 23 o'r Ddeddf Sylweddau Peryglus cyn 19 Awst 2010 ac ni chaniateir dyroddi hysbysiad tramgwydd sylweddau peryglus cyn y dyddiad hwnnw mewn perthynas â sylwedd peryglus sydd ar unrhyw dir, neu uwch ei ben neu oddi tano,–

(a) os oedd y sylwedd yn bresennol ar unrhyw dir, neu uwch ei ben neu oddi tano ar unrhyw adeg o fewn y cyfnod o 12 mis yn gorffen ar 19 Mawrth 2010 ac nad oedd yn sylwedd neu'n faintioli o sylwedd yr oedd yn ofynnol cael cydsyniad sylweddau peryglus ar ei gyfer cyn y dyddiad hwnnw; a

(b) os nad yw'r sylwedd yn bresennol yn ystod y cyfnod sy'n cychwyn ar 19 Mawrth 2010 ac sy'n gorffen ar 18 Awst 2010 mewn maintioli sy'n fwy yn gyfunol na'r maintioli sefydledig.

(2) Ym mharagraff (1) ystyr "y maintioli sefydledig", mewn perthynas ag unrhyw dir, yw uchafswm y maintioli oedd yn bresennol ar y tir, neu uwch ei ben neu oddi tano ar unrhyw adeg o fewn y cyfnod o 12 mis sy'n gorffen ar 19 Mawrth 2010.

NOTES TO PART A

1. Ammonium nitrate: fertilisers capable of self-sustaining decomposition

This applies to ammonium nitrate-based compound/composite fertilisers (compound/ composite fertilisers containing ammonium nitrate with phosphate and/ or potash) in which the nitrogen content as a result of ammonium nitrate is

and which are capable of self-sustaining decomposition according to the UN Trough Test (see United Nations Recommendations on the Transport of Dangerous Goods: Manual of Tests and Criteria (2003), Part III, sub-section 38.2).

2. Ammonium nitrate: fertiliser grade

This applies to straight ammonium nitrate-based fertilisers and to ammonium nitrate-based compound/composite fertilisers in which the nitrogen content as a result of ammonium nitrate is

and which satisfy the detonation resistance test described in Schedule 2 to the Ammonium Nitrate Materials (High Nitrogen Content) Safety Regulations 2003.

3. Ammonium nitrate: technical grade

NOTES TO PART B

1. Substances and preparations must be classified for the purposes of this Schedule according to regulation 4 of the Chemicals (Hazard Information and Packaging for Supply) Regulations 2009(14) (CHIP) whether or not the substance or preparation is required to be classified for the purposes of those Regulations or, in the case of a pesticide approved under the Food and Environment Protection Act 1985(15), in accordance with the classification assigned to it by that approval.

2. An "explosive" means:

Included in this definition are pyrotechnics, which for the purposes of these Regulations are defined as substances (or mixtures of substances) designated to produce heat, light, sound, gas or smoke or a combination of such effects through self-sustained exothermic chemical reactions.

Where a substance or preparation is classified by both UN/ADR and risk phrase R2 or R3, the UN/ADR classification must take precedence over assignment of risk phrases.

Substances and articles of Class 1 are classified in any of the divisions 1.1 to 1.6 in accordance with the UN/ADR classification scheme. The divisions concerned are:

Division 1.1: Substances and articles which have a mass explosion hazard (a mass explosion is an explosion which affects almost the entire load virtually instantaneously).

Division 1.2: Substances and articles which have a projection hazard but not a mass explosion hazard.

Division 1.3: Substances and articles which have a fire hazard and either a minor blast hazard or a minor projection hazard or both, but not a mass explosion hazard:

(a) combustion of which gives rise to considerable radiant heat; or

(b) which burn one after another, producing minor blast or projection effects or both.

Division 1.4: Substances and articles which present only a slight risk in the event of ignition or initiation during carriage. The effects are largely confined to the package and no projection of fragments of appreciable size or range is to be expected. An external fire will not cause virtually instantaneous explosion of virtually the entire contents of the package.

Division 1.5: Very insensitive substances having a mass explosion hazard which are so insensitive that there is very little probability of initiation or of transition from burning to detonation under normal conditions of carriage. As a minimum requirement they will not explode in the external fire test.

Division 1.6: Extremely insensitive articles which do not have a mass explosion hazard. The articles contain only extremely insensitive detonating substances and demonstrate a negligible probability of accidental initiation or propagation. The risk is limited to the explosion of a single article.

Included in this definition are also explosive or pyrotechnic substances or preparations contained in articles. In the case of articles containing explosive or pyrotechnic substances or preparations, if the quantity of the substance or preparation contained is known, that quantity must be considered for the purposes of these Regulations. If the quantity is not known, then, for the purposes of these Regulations, the whole article must be treated as explosive.

3. In categories 6, 7, 8 and 9, "flammable", "highly flammable", and "extremely flammable" mean–

(a) flammable liquids means substances and preparations having a flash point equal to or greater than 21 °C and less than or equal to 55°C (risk phrase R 10), supporting combustion;

(b) highly flammable liquids means–

(i) substances and preparations which may become hot and finally catch fire in contact with air at ambient temperature without any input of energy (risk phrase R 17);

(ii) substances and preparations which have a flash point lower than 55°C and which remain liquid under pressure, where particular processing conditions, such as high pressure or high temperature, may create major-accident hazards; and

(iii) substances and preparations having a flash point lower than 21 °C and which are not extremely flammable (risk phrase R 11, second indent);

(c) extremely flammable gases and liquids means–

(i) liquid substances and preparations which have a flash point lower than 0 °C and the boiling point (or, in the case of a boiling range, the initial boiling point) of which at normal pressure is less than or equal to 35 °C (risk phrase R 12, first indent),

(ii) gases which are flammable in contact with air at ambient temperature and pressure (risk phrase R12, second indent), which are in a gaseous or supercritical state, and

(iii) flammable and highly flammable liquid substances and preparations maintained at a temperature above their boiling point.

NOTES TO PARTS A AND B

1. Mixtures and preparations must be treated in the same way as pure substances provided they remain within the concentration limits set according to their properties under the relevant provisions specified in CHIP, unless a percentage composition or other description is specifically given.

2. In the case of substances and preparations with properties giving rise to more than one classification the lowest thresholds must apply.

3. Where a substance or group of substances listed in Part A also falls within a category of Part B, the controlled quantities set out in Part A must be used.

4. In the case of an establishment where no individual substance or preparation is present in a quantity above or equal to the relevant controlled quantity for that substance or preparation, the addition of hazardous substances to determine the controlled quantity must be carried out according to the following rule:

If the sum–

(where qx = the quantity of hazardous substance x (or category of substance) present,

  • Q = the relevant controlled quantity (Q) from Part A or Part B, except for those substances for which column 3 of Part A contains a quantity Q*, in which case the quantity Q* must be used in place of the controlled quantity Q in column 2)

  • then the controlled quantity of each of the substances which are added together in accordance with each of paragraphs 5(a) to (c) below must be deemed to be present for the purposes of sections 4(2), 14(2)(c), 23(2)(a) and of section 181 (enforcement notice to have effect against subsequent development) of the Town and Country Planning Act 1990(17) as substituted by paragraph 8 of Schedule 4.

5. The addition rule in paragraph 4 will apply for the following circumstances:–

(a) for the addition of substances and preparations named in Part A and classified as toxic or very toxic, together with substances and preparations falling into categories 1 or 2 of Part B;

(b) for the addition of substances and preparations named in Part A and classified as oxidising, explosive, flammable, highly flammable, or extremely flammable, together with substances and preparations falling into categories 3, 4, 5, 6, 7, 8 or 9 of Part B;

(c) for the addition of substances and preparations named in Part A and classified as dangerous for the environment (R50 (including R50/53) or R51/53), together with substances and preparations falling into categories 10(i) or 10(ii) of Part B.

PART C SUBSTANCES USED IN AN INDUSTRIAL CHEMICAL PROCESS

NOTES TO PART C

1. The expression "which it is believed may be generated during loss of control of an industrial chemical process" has the same meaning as in the Directive.

Mae Erthygl 12 o Gyfarwyddeb Seveso II yn ei gwneud yn ofynnol i bolisïau defnyddio tir roi sylw i'r amcanion o rwystro damweiniau mawr a chyfyngu ar ganlyniadau damweiniau o'r fath; ac fod yr amcanion hyn yn cael eu cyflawni drwy reolaethau a'r gofyniad i sicrhau fod awdurdodau cynllunio yn llunio gweithdrefnau ymgynghori priodol er mwyn hwyluso rhoi'r polisïau hyn a pholisïau eraill a sefydlwyd o dan yr Erthygl hon ar waith. Mae hefyd yn ei gwneud yn ofynnol i Aelod-wladwriaethau roi sylw i'r angen, dros y tymor hir, i gynnal pellteroedd priodol rhwng sefydliadau a gwmpesir gan y Gyfarwyddeb ac ardaloedd preswyl, ardaloedd a ddefnyddir gan y cyhoedd, ac ardaloedd o sensitifrwydd naturiol neu o ddiddordeb naturiol. Mae Cyfarwyddeb 2003 yn estyn y gofyniad hwn i gynnwys adeiladau a ddefnyddir gan y cyhoedd, prif lwybrau trafnidiaeth cyn belled ag y mae modd, ac ardaloedd hamddena.

Mae'r diwygiadau a wnaed gan Gyfarwyddeb 2003 hefyd yn estyn cwmpas Cyfarwyddeb Seveso II drwy ddiwygio Atodiad I i Gyfarwyddeb Seveso II (cymhwyso Cyfarwyddeb Seveso II). Mae Atodiad I yn gymwys i bresenoldeb sylweddau peryglus (gan gynnwys pethau a gymysgir a phethau a baratoir) mewn unrhyw sefydliad. Wrth wneud felly, mae Atodiad I yn penderfynu cymhwysedd Erthygl 12. Mae'r Atodiad I newydd yn cynyddu'r amrediad o sylweddau peryglus, ac yn adolygu'r diffiniadau o'r sylweddau peryglus a restrwyd yn Atodiad I o Gyfarwyddeb Seveso a'r maintioli ohonynt sy'n dod â hwy o fewn cwmpas y Gyfarwyddeb. Ymhlith y sylweddau peryglus hynny sydd bellach wedi'u cynnwys yn rhinwedd y diwygiadau a wnaed gan Gyfarwyddeb 2003 y mae'r rheini sy'n gysylltiedig â pheryglon sy'n codi o weithgareddau storio a phrosesu penodol mewn mwyngloddio.

Mae rheoliad 2 yn diwygio Rheoliadau Cynllunio (Sylweddau Peryglus) 1992 (y Rheoliadau Sylweddau Peryglus) drwy osod yn ei lle Atodlen 1 newydd sy'n rhagnodi'r sylweddau sy'n sylweddau peryglus a'r maintioli ohonynt sydd dan reolaeth, er mwyn rhoi eu heffaith i'r diwygiadau a wnaed i Atodiad I o Gyfarwyddeb Seveso II gan Gyfarwyddeb 2003. Mae rheoliad 2 hefyd yn gwneud rhai mân ddiwygiadau i adlewyrchu'r ffaith bod Atodlen 1 newydd wedi cael ei gosod yn ei lle.

Mae rheoliad 3 yn gwneud darpariaeth drosiannol er mwyn sicrhau nad yw cydsyniadau presennol ar sylweddau peryglus yn cael eu trin fel rhai annilys oherwydd fod sylweddau peryglus wedi cael eu hail enwi neu eu hail gategoreiddio.

Mae rheoliad 4 yn rhoi imiwnedd drosiannol rhag erlyniad ac achosion o dramgwydd am gyfnod o chwe mis o'r diwrnod pan ddaw'r Rheoliadau hyn i rym. Yn ystod yr adeg hon, caniateir gwneud cais am gydsyniad.

Paratowyd asesiad effaith mewn perthynas â'r Rheoliadau hyn. Fe'i gosodwyd yn Llyfrgell Llywodraeth Cynulliad Cymru a gellir cael copïau ohono oddi wrth y Gyfarwyddiaeth Gynllunio, Llywodraeth Cynulliad Cymru, Parc Cathays, Caerdydd CF 10 3NQ.
