The Education (Student Information) (Wales) (Amendment) Regulations 2024

The Welsh Ministers make the following Regulations in exercise of the powers conferred on them by section 253A(2)(c)( 1) and section 262(3)(c) of the Apprenticeships, Skills, Children and Learning Act 2009( 2).

Title and coming into force

1.—(1) The title of these Regulations is the Education (Student Information) (Wales) (Amendment) Regulations 2024.

(2) These Regulations come into force on 1 August 2024.

Interpretation

2.  In these Regulations “ the 2017 Regulations” means the Education (Student Information) (Wales) Regulations 2017( 3).

Amendments to the Education (Student Information) (Wales) Regulations 2017

3.  In regulation 2 of the 2017 Regulations, in the definition of “learning provider” after “Welsh Ministers” insert “or the Commission for Tertiary Education and Research( 4)”.

4.  In Part 1 of Schedule 2 to the 2017 Regulations—

(a) for “The Higher Education Funding Council for Wales” substitute “The Commission for Tertiary Education and Research”;

(b) for “The Higher Education Funding Council for England” substitute “The Office for Students( 5)”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Education (Student Information) (Wales) Regulations 2017 to reflect changes made by the Tertiary Education and Research (Wales) Act 2022 and the Higher Education and Research Act 2017. They add references to the Commission for Tertiary Education and Research and the Office for Students, and remove references to the Higher Education Funding Council for Wales and the Higher Education Funding Council for England.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with these Regulations.
