I, EITHNE FITZGERALD, Minister of State at the Department of Enterprise and Employment, in exercise of the powers conferred on me by sections 1 (2) and 4 (3) of the Safety, Health and Welfare at Work Act, 1989 (No. 7 of 1989), and the Labour (Transfer of Departmental Administration and Ministerial Functions) Order, 1993 ( S.I. No. 18 of 1993 ), and the Enterprise and Employment (Delegation of Ministerial Functions) (No. 2) Order, 1995 ( S.I. No. 43 of 1995 ), and after consultation with the National Authority for Occupational Safety and Health, hereby order as follows:

1. This Order may be cited as the Safety, Health and Welfare at Work Act, 1989 (Repeals and Revocations) Order, 1995.

2. Section 4 (3) of the Safety, Health and Welfare at Work Act, 1989 (No. 7 of 1989), shall come into operation on the 21st day of December, 1995, for the purpose of effecting the repeal or revocation, as the case may be, of each enactment (being an existing enactment within the meaning of the Act) mentioned in column (2) of the Schedule of this Order, to the extent specified in column (3) of that Schedule opposite the mention in the said column (2) of such an enactment.

EXPLANATORY NOTE.

The purpose of this Order is to activate the repeal or revocation of certain provisions of the existing enactments, as provided for in sections 1 (2) and 4 (3) of the Safety, Health and Welfare at Work Act, 1989 (No. 7 of 1989), so as to avoid overlapping or duplication between those provisions and provisions of the Act or of the Safety, Health and Welfare at Work (General Application) Regulations, 1993 ( S.I. No. 44 of 1993 ) and to repeal or revoke other provisions of the existing enactments which are obsolete.
