"Trial of civil causes' by jury was re-introduced, after long agitation and against considerable opposition, in 1815. At that period there were large arrears in appeals from the Court of Session to the House of Lords. Many issues which are now finally decided by jury were then taken on appeal to the highest court in the realm, and some of these cases, being purely questions of fact, were a cause of great difficulty in the House of Lords. As a result, Lord Eldon, in 1815, introduced a bill, which became a law, establishing a jury court separate from the other courts for the sole purpose of trying questions of fact remitted to it from the other courts. This jury system was of the English type. In 1830 the separate jury court was abolished and jury trial was incorporated with the ordinary jurisdiction of the Court of Session."

The electronic versions of the text from each of these law report series was provided by The Scottish Council of Law Reporting     

Morison collected most of the Scottish Court of Session law reports from 1540-1808 and organised them by subject matter - find BAILII's subject index to these reports below. The Notes section from Tait's Index To The Decisions Of The Court Of Session informs us that these reports were gathered from all sorts of early sources. These Notes also provide further information about Morison's Dictionary, and other original collections of reports. Although Morison assigned two levels of subjects to each report there was never a compiled subject index to the the whole work. BAILII is proud of being able to generate a Subject Index to these Decisions of the Court of Session 1540 - 1808 which is currently a work in progress given the difficulties caused by the variation in the original subject headings the several law report series included (each having differing subject headings) and the scanning process itself (although this seems to have been done to a very high standard) There is also a Subject Index Decisions of the House of Lords (Scotland) 1709 - 1861. A broader search for all of these reports using BAILII Case Law Search (restricting the search to Scottish Court of Session) may turn up more reports dealing with any given topic.

Many of these reports used the long s ' ſ ' this was derived from the old Roman cursive medial s so we often see an f in place of an s for example:

For definitions of words found in these reports and in the subject index a useful source is the Dictionary of the Scots Language (DSL) which may be found at Dictionary of the Scots Language. Inevitably the language used by lawyers differs from that in everyday speech and the two dictionaries found on the DSL site (pre-1770 = DOST and post-1700 = SND) should be used with caution when dealing with specifically legal terminology.
