Education (Teacher Training Hardship Grants) (England) Regulations 2001

  Made 30th March 2001 
  Laid before Parliament 30th March 2001 
  Coming into force 20th April 2001 

In exercise of the powers conferred on the Secretary of State by sections 50 and 63(3) of the Education (No. 2) Act 1986[1], the Secretary of State for Education and Employment hereby makes the following Regulations:

Citation, commencement and application
     1.  - (1) These Regulations may be cited as the Education (Teacher Training Hardship Grants) (England) Regulations 2001 and shall come into force on 20th April 2001.

    (2) These Regulations shall only apply in relation to England.

Interpretation
    
2. In these Regulations - 

Grants for teacher training
     3. The Agency may pay a grant to a person undertaking a post-graduate teacher training course which began before 1st September 2000 to facilitate and encourage the training of that person as a teacher in accordance with these Regulations.

Conditions
    
4.  - (1) No grant shall be paid under regulation 3 to a person unless, in the opinion of the Agency, he is suffering from financial hardship.

    (2) Nothing in this regulation shall be taken as limiting the power of the Agency to determine conditions under regulation 5.

Further conditions
    
5. The making of a payment shall be dependent on the fulfilment of such further conditions as may be determined by the Agency.

Repayment
    
6. Where in the opinion of the Agency any information or assumption on the basis of which a grant has been paid is incorrect, the person to whom the grant was paid shall at the request of the Agency repay such sum not exceeding the total grant as the Agency may request.

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations provide for the Teacher Training Agency to make a grant to a person engaged in a post-graduate course of initial teacher training which began before 1st September 2000 if, in the opinion of the Agency, that person is suffering from financial hardship. These Regulations also provide for the Agency to determine further conditions which must be fulfilled in order for a grant to be payable.

[1] 1986 c. 61; section 50 was amended by section 278(6) of, and paragraph 102 of Schedule 19 to, the Education Act 1993 (c. 35) (which continue in force by virtue of paragraph 65 of Schedule 37 to the Education Act 1996 (c. 56)) and section 13 of the Education Act 1994 (c. 30), and section 63(3) was amended by paragraph 107(a) of Schedule 19 to the Education Act 1993. The Secretary of State can exercise the power under section 50 only in relation to England: see article 2 of and Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672).back
