The Health Authorities (Membership and Procedure) Amendment Regulations 2004

  Laid before Parliament 14th January 2004 
  Coming into force 1st March 2004 

The Secretary of State for Health, in exercise of the powers conferred upon him by section 126(3) and (4) of, and paragraphs 10 and 12 of Schedule 5 to, the National Health Service Act 1977[1] and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Health Authorities (Membership and Procedure) Amendment Regulations 2004 and shall come into force on 1st March 2004.

Amendment of Regulations
     2. In Schedule 2 to the Health Authorities (Membership and Procedure) Regulations 1996[2] (Special Health Authorities of which the chairman and members are not disqualified under regulation 10(1)(g)), after "National Treatment Agency" insert "NHS Professionals Special Health Authority"[3] and "NHSU"[4].

EXPLANATORY NOTE

(This note is not part of the Order)


These Regulations amend Schedule 2 to the Health Authorities (Membership and Procedures) Regulations 1996 which makes provision relating to the membership and procedure of Strategic Health Authorities. The amendment will provide that the chairman and members of the NHS Professionals Special Health Authority or the NHSU, both Special Health Authorities established under the National Health Service Act 1977, are not disqualified for appointment as a chairman or member of a Strategic Health Authority.

The functions of the Secretary of State under these provisions are, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2(a) of the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672, as amended by section 66(5) of the 1999 Act.back
