The Cardiff (Llandaff North, Whitchurch, Llanishen, Lisvane, Ely and St. Fagans Communities) Order 2003

The Local Government Boundary Commission for Wales, having submitted to the National Assembly for Wales, in accordance with sections 54(1) and 58(1) of the Local Government Act 1972[1], a report dated November 2002 on a review conducted by the County Council of the City and County of Cardiff on the boundaries between the communities of: Llandaff North and Whitchurch; Llanishen and Lisvane; and Ely and St. Fagans; in the City and County of Cardiff, together with proposals formulated by the Commission thereon;
And the National Assembly for Wales having decided to give effect to those proposals, without modification;
And more than six weeks having elapsed since those proposals were made;
The National Assembly for Wales, in exercise of the powers conferred on the Secretary of State by section 58(2) of the Local Government Act 1972 and which are vested in the National Assembly for Wales so far as exercisable in relation to Wales[2], now makes the following Order:
Title and commencement

- (1) This Order is called the Cardiff (Llandaff North, Whitchurch, Llanishen, Lisvane, Ely and St. Fagans Communities) Order 2003.
(2) This Order comes into force on 1 April 2004, which is the appointed day for the purposes of the 1976 Regulations, except that for the purposes set out in Regulation 4 of the 1976 Regulations, this Order comes into force on 1 December 2003.
Interpretation

In this Order -
"the 1976 Regulations" ("Rheoliadau 1976") means the Local Government Area Changes Regulations 1976[3];
Map A ("Map A") means the map prepared by the National Assembly for Wales and marked "Map A City and County of Cardiff (Llandaff North and Whitchurch) Order 2003" and deposited in accordance with Regulation 5 of the 1976 Regulations;
Map B ("Map B") means the map prepared by the National Assembly for Wales and marked "Map B City and County of Cardiff (Llanishen and Lisvane) Order 2003" and deposited in accordance with Regulation 5 of the 1976 Regulations;
Map C ("Map C") means the map prepared by the National Assembly for Wales and marked "Map C City and County of Cardiff (Ely and St. Fagans (1)) Order 2003" and deposited in accordance with Regulation 5 of the 1976 Regulations; and
Map D ("Map Ch") means the map prepared by the National Assembly for Wales and marked "Map D City and County of Cardiff (Ely and St. Fagans (2)) Order 2003" and deposited in accordance with Regulation 5 of the 1976 Regulations.
Amendment of community boundaries

The boundaries between the communities of: Llandaff North and Whitchurch; Llanishen and Lisvane; and Ely and St. Fagans; are amended in accordance with Article 4.
New Community Boundaries

- (1) The boundary between the communities of Llandaff North and Whitchurch is to be as shown on Map A marked as the "New Community Boundary".
(2) The boundary between the communities of Llanishen and Lisvane is to be as shown on Map B marked as the "New Community Boundary".
(3) The boundary between the communities of Ely and St. Fagans is to be as shown on Maps C and D marked as the "New Community Boundary".
Additional Community Councillor
5.
The number of community councillors to be returned for the community of St. Fagans is increased to 9.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order, made in accordance with section 58(2) of the Local Government Act 1972, gives effect to proposals by the Local Government Boundary Commission for Wales. The effect of the Order is that there are changes between the community boundaries of: Llandaff North and Whitchurch; Llanishen and Lisvane; and Ely and St. Fagans. There will be an increase of one community councillor in the community of St. Fagans.
The Local Government Boundary Commission for Wales reported in November 2002 on a review conducted by the County Council of the City and County of Cardiff on the boundaries between the communities of: Llandaff North and Whitchurch; Llanishen and Lisvane; and Ely and St. Fagans; in the City and County of Cardiff. The report recommended changes to the existing boundaries. This Order gives effect to those recommendations without modification.
Prints of the boundary maps A-D are deposited and may be inspected during normal office hours at the offices of the County Council of the City and County of Cardiff at County Hall, Atlantic Wharf, Cardiff and at the offices of the National Assembly for Wales at Cathays Park, Cardiff (Local Government Modernisation Division).
The Local Government Area Changes Regulations 1976 (as amended) ("the 1976 Regulations"), referred to in Article 1(4) of this Order contain incidental, consequential, transitional and supplementary provision about the effect and implementation of orders such as this.
By virtue of Regulation 40 of the 1976 Regulations, references in The City and County of Cardiff (Electoral Arrangements) Order 1998 to the communities of Llandaff North, Whitchurch, Llanishen, Lisvane, Ely and St. Fagans will be construed as references to those communities as altered by this Order.
