WELSH LANGUAGE

The Welsh Language Schemes (Public Bodies) Order 2004

  Made 14th January 2004 
  Coming into force 1st February 2004 

Whereas it appears to the National Assembly for Wales that the persons referred to in the Schedule to this Order are persons exercising functions of a public nature;

     And whereas it appears to the National Assembly for Wales that the persons referred to in the Schedule to this Order are persons all or substantially all of whose activities are conducted under an agreement, or in accordance with arrangements made with a person acting as servant or agent of the Crown;

     Now therefore, the National Assembly for Wales, in exercise of the powers conferred upon the Secretary of State by section 6(1) of the Welsh Language Act 1993[1], and now vested in the National Assembly[2], and of all other powers enabling it in that behalf, hereby makes the following Order:

Title and commencement
     1. This Order is called the Welsh Language Schemes (Public Bodies) Order 2004 and comes into force on 1st February 2004.

Specification of Public Bodies
    
2. The persons referred to in the Schedule to this Order are specified for the purposes of Part II of the Welsh Language Act 1993.

THE SCHEDULE
Article 2

A company which, by virtue of an appointment under section 6 of the Water Industry Act 1991[
4] or by virtue of a variation of such an appointment under section 7 of that Act, is the water undertaker or the sewerage undertaker, or both, for the whole or any part of Wales.



EXPLANATORY NOTE

(This note is not part of the Order)


Under Part II of the Welsh Language Act 1993 ("the Act") the Welsh Language Board may give notice in writing to any public body to produce a Welsh Language Scheme. Section 6 of the Act lists various public bodies for the purposes of Part II of the Act and provides that the Secretary of State (now the National Assembly) may specify further public bodies for those purposes.

This Order specifies further public bodies for the purposes of Part II of the Act namely bodies which are water undertakers or sewerage undertakers, or both, and which operate in Wales.

Four previous Orders have been made under section 6 of the Act:

The Welsh Language Schemes (Public Bodies) Order 1996 (S.I. 1996/1898);

The Welsh Language Schemes (Public Bodies) Order 1999 (S.I. 1999/1100);

The Welsh Language Schemes (Public Bodies) Order 2001 (S.I. 2001/2550 (W.215)); and

The Welsh Language Schemes (Public Bodies) Order 2002 (S.I. 2002/1441 (W.145)).
